In short

  • Use this site and the service lawfully and honestly; do not try to break them or get into other organizations' data.
  • Your content and your data stay yours. You give us only the permission needed to run the service for you.
  • During early access the service is provided as-is and free; we do our best, and say plainly what is not ready.
  • Either side can end the relationship; you can export your data before and after.

Contents

1. Agreement

By using entrywick.com, sending us a request, or using an EntryWick workspace during early access, you agree to these terms on behalf of yourself and, where you act for one, your organization. If you do not agree, do not use the site or the service.

2. What EntryWick is

EntryWick is software for event registration, ticketing and check-in, provided by iSmart Web ("EntryWick", "we"). The organization that opens a workspace (the "Organization") runs its own events on it and is responsible for its events, its content and its treatment of the people who register. We provide the software and, during pilots, hands-on help.

3. Workspaces and accounts

The person who opens a workspace is its Owner and is responsible for who else is given access. Keep credentials private, turn on two-factor authentication for privileged roles, and tell us at once if you believe an account has been compromised. You must be at least 18 to hold an account; registrants of any age may be entered by a guardian through forms the Organization controls.

4. Acceptable use

Use the service only for lawful events and purposes. Do not probe, scan or test the service's security except as described in responsible disclosure; do not attempt to access another organization's data; do not send unsolicited bulk messages through the service; do not upload unlawful or infringing content. The full list is in the Acceptable use policy, which is part of these terms.

5. Your content and your data

Everything an Organization puts into EntryWick — event pages, forms, people's records, files — is the Organization's. You grant us the limited licence needed to store, process, display and transmit it to run the service for you. We do not use your data to train models, sell it, or advertise with it. Our processing of personal data is described in the Privacy policy and the Data processing terms. You can export everything at any time.

6. Our content

The EntryWick software, documentation, templates, brand and this website are ours or our licensors'. You may not copy, resell or reverse-engineer them except as the law allows. Feedback you give us may be used without obligation to you.

7. Early access and pilots

Until early access opens, the service is provided free under the Free pilot terms. It is provided as-is: features may change, and some are not yet complete — we will tell you which before your event. We will not knowingly let an Organization run an event on something we believe is not ready.

8. Fees

No fees are charged during pilots. When paid plans open, prices, billing modes and what each plan includes will be published on the pricing page and in the full service terms. Payments taken by an Organization from its registrants run through the Organization's own payment account; we are not party to those transactions. Nothing is charged during early access, so nothing is refundable; refund rules for paid plans are published with the full service terms.

9. Availability and support

We aim for continuous availability and publish a status page. We may suspend the service briefly for maintenance, and immediately if needed to protect it or comply with law. Support is by email; pilot organizations also have a direct contact on event day.

10. Warranties and liability

During early access the service is provided "as is" without warranty of any kind. To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss, and our total liability to an Organization for any claim is limited to the fees it paid us in the twelve months before the claim (which, during a free pilot, is zero). Nothing here limits liability that cannot be limited by law.

11. Ending the agreement

An Organization may close its workspace at any time (Owner, two-factor code, a 30-day hold that can be stopped). We may suspend or close a workspace that breaches these terms, after notice where practical. On closure, data is kept for export for 30 days and then deleted, except what the law requires us to keep.

12. Changes to these terms

We may update these terms. Material changes are announced by email to Owners and on this page at least 30 days before they take effect. Continuing to use the service after that date is acceptance.

13. Governing law

These terms are governed by the laws of the State of Texas and the United States. Disputes are resolved in the state or federal courts in Harris County, Texas, unless the law of your location gives you a right to a different forum.
